Abstract:

If the ICC's goal of adopting the principle of judicial integration is to strike a kind of balance between the need for the state to preserve its national sovereignty and the establishment of a permanent international judicial system that seeks to intervene to protect human rights, there are those who see the icc's work as an infringement of the national sovereignty of states, as long as it has priority in prosecuting international perpetrators when granting the UN Security Council the right to refer them, even if the state to which they belong is not a party to the treaty.

الملخص: اذا كان هدف المحكمة الجنائية الدولية من اعتماد مبدا التكامل القضائي هو تحقيق نوع من التوازن بين ضرورة حفاظ الدولة على سيادتها الوطنية وبين تأسيس نظام قضائي دولي دائم يسعى الى التدخل من اجل حماية حقوق االنسان، فان هناك من يرى في عمل المحكمة الجنائية الدولية مساسا بالسيادة الوطنية للدول، مادامت لها االولوية في مقاضاة مرتكبي الجرائم الدولية عند منح مجلس االمن الدولي الحق في احالة هؤالء عليها، حتى ولو لم تكن الدولة التي ينتمون اليها طرفا في المعاهدة المؤسسة لها.
